Terms of Service — Simply Toffee

Welcome to Simply Toffee. “We,” “us,” and “our” refer to Saadnation LLC dba Simply Toffee. We sell handcrafted confectionery through our website (the “Services”). By using the Services, you agree to these Terms and our Privacy Policy.


1) Eligibility & Accounts

You must be the age of majority in your state to purchase. If you create an account, keep your credentials secure; you’re responsible for activity under the account.

2) Food Safety & Allergen Notice

Our products contain milk and tree nuts and may contain soy. They are produced in a facility that processes these allergens. Read labels carefully and contact us with questions before ordering if you have allergies or dietary restrictions.

3) Products & Availability

We try to display products accurately, but colors and appearance may vary by device. We may limit quantities, discontinue items, or change descriptions or prices at any time.

4) Pricing, Taxes & Promotions

Prices are shown in U.S. dollars and exclude taxes, shipping, and handling unless stated. Applicable taxes are calculated at checkout based on destination and product taxability. Promotions may have their own terms; if they conflict with these Terms, promotional terms control for that offer.

5) Orders & Cancellations

Your order is an offer to buy; we may accept or decline at our discretion (for example, due to inventory, suspected fraud, or pricing error). We charge your payment method upon checkout. You may request cancellation before fulfillment; once a label is purchased or the order is handed to the carrier, we cannot modify or cancel it.

6) Shipping, Heat, & Risk of Loss

We typically ship Monday–Wednesday to minimize time in transit. Delivery windows are estimates and not guarantees. Title and risk of loss pass to you when we hand the package to the carrier. Please bring packages indoors promptly—chocolate/toffee can melt. During warm weather, we may add insulation/ice packs or limit ship days at our discretion.

Address Accuracy & Undeliverable Packages

Enter a complete, accurate shipping address at checkout. If a parcel is returned due to an incorrect or incomplete address, refusal, or unclaimed delivery, we can reship to a corrected address at cost or refund minus shipping once received. Food items returned to us are discarded for safety.

7) Returns, Replacements & Refunds (Food is Non‑Returnable)

Because our products are perishable food, we generally do not accept returns. If your order arrives damaged, melted, incorrect, or missing items, email us within 7 days with your order # and photos; we’ll replace or refund at our discretion. See our Refund & Returns Policy for full details.

8) Personal Use; No Resale

Purchases are for personal or gift use only and not for commercial resale without our written permission.

9) Gift Cards

Gift cards are final sale and not refundable, reloadable, or redeemable for cash unless required by law.

10) Intellectual Property

All content on the Services—including text, logos, graphics, images, video, and design—is owned by Simply Toffee or our licensors and protected by law. You may not copy, distribute, or create derivative works without our written consent.

11) Reviews & Feedback

If you submit reviews or feedback, you grant us a perpetual, worldwide, royalty‑free license to use and display them for any lawful purpose. You represent you own the content, it’s accurate, and it doesn’t infringe others’ rights. We may moderate or remove content at our discretion.

12) Third‑Party Services & Links

Our store is hosted by Shopify and may use apps or link to third‑party sites. We’re not responsible for third‑party content, policies, or services. Use them at your own risk.

13) Relationship with Shopify

Simply Toffee is powered by Shopify, but purchases are solely between you and Saadnation LLC dba Simply Toffee. Shopify is not a party to your transactions and is not liable for any claims arising from your purchases.

14) Disclaimer of Warranties

Except as expressly stated, the Services and products are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose. We do not guarantee uninterrupted or error‑free operation.

15) Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, data, or goodwill) arising from your use of the Services or products. Our total liability for any claim will not exceed the amount you paid for the product at issue.

16) Indemnification

You agree to indemnify and hold harmless Saadnation LLC dba Simply Toffee, our officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the Services.

17) Prohibited Uses

You may not use the Services for unlawful purposes; to infringe intellectual property; to transmit malware; to scrape, spam, or reverse engineer; to harass or harm others; or to interfere with the site’s operation.

18) Governing Law & Venue

These Terms are governed by the laws of the State of Ohio. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Mahoning County, Ohio for any dispute not subject to small‑claims jurisdiction.

19) Changes to the Terms

We may update these Terms from time to time. Changes take effect when posted. If we make material changes, we’ll provide notice consistent with applicable law. Your continued use of the Services after updates means you accept the revised Terms.
